USCIS EB-1 & I-140 Approval & Denial Statistics

USCIS periodically publishes its approval and denial statistics for all types of applications. This information is available through their website.

While these charts can help illustrate the demand for these classifications, they offer no indication of trends such as RFE issuance (Request for Evidence: this is what happens when the officer wants more information about the case before they can approve it) or what types of cases, fields, and criteria are most difficult.

Curran & Berger EB-1, EB-2, and O-1 Approval & Denial Statistics

From anecdotal evidence and our own experience, we are aware of a general trend toward increased RFE issuance and a more strict look at criteria satisfaction in recent years. Our experience and constant research help keep us ahead of the curve.

About Our Success Rate

In past years, we did not find it necessary to calculate our success rate. Most of our cases were being approved, and many without a request for evidence. Our clients were consistently approved for permanent residence, even if sometimes we had to figure out a plan B. However, because this is a frequently asked question, we started tracking our numbers in 2012.

Our expertise does not just come into play envisioning a strategy and preparing evidence. We will give you an honest evaluation of the strengths and weaknesses of your case about one month after we begin work, and again when we are ready to file.

To get the process started, please fill out this consultation form. It allows us to perform an initial review of your credentials so that we can meaningfully discuss your case.
